Scottish Civil Justice Hub: Domestic Abuse and Child Contact survey

Domestic Abuse and Child Contact: the interface between criminal land civil proceedings.

This Scottish Civil Justice Hub project aims to examine the processes of child contact proceedings, particularly child welfare hearings, and their interaction with criminal proceedings in the context of domestic abuse. The information collected and analysed will provide high quality evidence about the current justice system and produce policy and practice recommendations to inform debates about how to address child contact when there has been domestic abuse in Scotland and more widely.

The SCJH is carrying out a survey – to be completed by 3 December 2021 – of legal professionals, asking people for their experience about the interface between child contact matters, particularly child welfare hearings, and criminal proceedings in the context of domestic abuse. The purpose of this survey is to gather information about how these processes operate and interact, for example if the timing of one is affected by what is happening in the other.
