What is disclosed?

  • Basic: unspent convictions
  • Standard: unspent & relevant spent convictions, sex offenders registration
  • PVG: unspent & relevant spent convictions, sex offenders registration, ‘other relevant information’, information about barred lists (in some cases) and civil orders + ongoing monitoring commence

Membership of the PVG Scheme

1. Are they working with *‘Vulnerable People’?
  • Child: an individual under the age of 18 years
  • Protected Adult: aged 16 years or over and in receipt of certain prescribed services
    - Health service
    - Registered/community care/welfare services

NB Health-related research is not generally considered part of these categories


2. Are they performing a **’Regulated Activity’?
  • Child
    • Caring for children
    • Teaching, instructing, training or supervising children
    • Being in sole charge of children
    • Unsupervised contact with children under arrangements made by a responsible person
    • Providing advice or guidance to a child, which relates to physical or emotional well-being, education or training
  • Protected Adult
    • Providing care for protected adults
    • Teaching, instructing, training and supervising protected adults
    • Being in sole charge of protected adults
    • Providing assistance, advice or guidance to protected adults

3. Are they working in a Regulated Establishment?
  • Child: Children’s Hospital
  • Protected Adult: Care/residential homes so not applicable to ICE building

4. Is the Regulated Activity in the Regulated Establishment part of normal duties or ‘incidental’?

NB Asking someone to join the PVG scheme for a position that is not regulated work is an offence under the PVG (Scotland) Act 2007
