Exercise of rights in Scotland by Children

Section 66 of the DPA states that the legal capacity of a child under the age of sixteen years to exercise any right under the DPA is based on the child's capacity to understand what it means to exercise that right. Subject to an assessment, a child of twelve years of age or more is generally presumed to be of sufficient age and maturity to understand.
